Information on the result of the first unrestricted oral tender for the sale of residential property No. 5, described in KW OL1E/00016723/2, located on the first floor of building No. 9 at Generała Władysława Sikorskiego Street in Ełk

Information on the result of the first unrestricted oral tender for the sale of residential real estate No. 5, described in KW OL1E/00016723/2, located on the first floor of building No. 9 at Generała Władysława Sikorskiego Street in Ełk, with usable area 28.20 m2 with a share of 1/100 of the part in common property forming part of a building and equipment which are not used exclusively for the use of the owners of the premises and the plot of land marked No. 144/2 with an area of 796 m2 and a share of 1/46 of a part of the plot of land marked No. 144/4 with an area of 2792 m2 disclosed in KW OL1E/00012704/5.

Starting price of residential property together with the share is – PLN 199,800.00 (one hundred and ninety-nine thousand eight hundred zlotys), including:

1/ price of the premises with the share of 1/100 of the land plot 144/2 is PLN 173,700.00 (including the price of a fractional part of the land PLN 3,400.00) - VAT rate - exempt Article 43(1)(10) of the Act of 11 March 2004 on the tax on goods and services (Journal of Laws of 2021, item 685 and 694, of 2020, items 2419, 2021, items 802, 1163, 1243, 1598 and 1626, and of 2020, item 2320)

2/ the share price of 1/46 of the plot of land 144/4 is 26.100,00 PLN - VAT will be added to the price obtained in the tender according to the rate in force on the date of conclusion of the sales contract.

The amount of the deposit – PLN 39,900.00 (thirty-nine thousand nine hundred zlotys).

There is no local zoning plan that its arrangements would include real estate located within the precinct 1 of the city of Ełk at 9 Sikorskiego Street, marked in the records report land numbers 144/2 and 144/4, and the Ełk City Council did not adopt a resolution on proceeding to the preparation of a local development plan spatial in the area covering the above-mentioned plots.

In addition, the Mayor of the City of Ełk issued the following decisions on determining the location of a public purpose investment:

No. 6/2008 of 9 April 2008, for the investment consisting in the "construction of a rain collector within the Centrum and Północ I housing estates", in the area comprising, m.in, property No. 144/4,
No 23/2008, of 18 November 2008, for an investment consisting in the 'construction of cable fiber optic line in relation to the building of the Energy District Distribution Ełk ul. Sportowa – station 110/15kV Ełk 2 ul. Wileńska", in the area comprising m.in property No. 144/4,
No. 16/2009, of 22 June 2009, for the investment consisting in the "extension of Wileńska and Grodzieńska streets together with the construction and reconstruction of the necessary technical infrastructure", in the area comprising, m.in, property No. 144/4,
No. 23/2012 of 24 December 2012, for the investment consisting in the "reconstruction of the low-pressure gas network with connections", in the area comprising, m.in, real estate No. 144/2 and 144/4,
No. 21/2015, of 22 December 2015, for the investment consisting in the "reconstruction of the sanitary sewage system of the Północ district as part of the project "Improvement of water and sewage management of the Ełk II agglomeration", in the area comprising, m.in, property No. 144/4,
No. 3/2018, of 06 March 2018, for an investment consisting in "construction of the SN-15kV cable power grid", in the area of covering m.in property No. 144/4.

As at the date of issue of the certificate, there are no outstanding legal decisions setting the development conditions for the subjects Parcels.

At the same time, I would like to inform you that the above-mentioned plot is not located on the revitalization area or the Special Revitalization Zone, in the act of 9 October 2015 on revitalization (Journal of Laws of the Republic of Poland). 2021, item 485).

The tender was set for February 3, 2022 at 1000 o'clock. Place of the tender - conference room in the Ełk City Hall at 4 Marszałka J. Piłsudskiego Street.

Within the prescribed period, i.e. by 28 January 2022, one deposit was received on the account of the Ełk City Hall. The depositor did not submit, within the prescribed period, a statement that he has no financial arrears towards the city of Ełk.

The person who paid the deposit could not be admitted to tender because it did not meet one of the conditions that allows joining the tender, i.e. did not submit a declaration of non-tender having financial arrears towards the city of Ełk. In addition, that person did not appear for the tender. Therefore, the tender ended with a negative result.
